Live blogging from the donkey convention, the Burnt Orange Report is reporting that chief pinata dimocrat party chair Boyd Richie is boasting of their legal petition and injunction to prohibit republicans in CD 22 from nominating a candidate to replace Tom DeLay on the November ballot. According to Richie, DeLay has not done enough to prove he changed his residency to Virginia and the RPT should not be allowed to name his replacement.
Um, like, who does Richie think should name the replacement candidate? Martians? Get a copy of the election code & have someone read it to you, dude.
UPDATE UPDATE UPDATE: Courtesy of a liberal blog in CD 22, Juanita’s, here’s a copy of the 57 page donk petition filed in Travis County as both party HQs are located here. Homie, you have obviously not followed your own advice. If you did, you would know TEC 145 requires that the chair must produce conclusive evidence from the public record that indicates DeLay will be inelgible to serve. Specifically, she must produce a document that proves DeLay will not be a resident on election day, and she must produce it on the day she makes the declaration (yesterday).
As of today, Thomas Dale DeLay is still registered to vote in Fort Bend. He is still claiming a homestead exemption on his home in Sugar Creek. I know, because I called the county elections office and the appraisal clerk. It’s called doing your homework. Both of these facts make a Viriginia driver’s license far short of conclusive.
Who does Richie think should pick the GOP nominee? Not Martians, but THE GOP VOTERS OF FORT BEND COUNTY. They picked their boy, by over 60%.
Imagine if shortly after the primary, a looming investigation of Sheila Jackson Lee made her defeat a certainity. Then imagine she attempted to have the TXDP try to replace her on the ballot with a candidate who could win.
Would the GOP stand for it?
That question is, of course, laughably rhetorical.
Go pull a case called Nixon v. Slagel… The (GOP) Texas Court of Appeals visited this issue in 1994 in the Drew Nixon (also GOP) state senate race. Have someone read it to you.
And leave this full contact sport to the people who actually have a playbook.

Actually, if the Democrats succeeed, there won’t be a need to name a replacement. DeLay will still be on the ballot. Maybe if he pays back his what he dsaved on his Texas homestead exemption, he won’t be a Texas resident, and he’ll also have to file another affidavit saying he didn’t tell the truth when he filed the previous affadavit saying he would run for the seat and would remain eligible to do so. Maybe if he stays on the ballot he’ll get lucky and win.

Strange: Your playbook must be missing a page or two. Ft Bend county is not the only county in CD 22. I’m sure the voters in Harris, Galveston, & Brazoria counties will forgive your slight.
It appears the GOP believed the evidence was conclusive, or Tina Benkiser would not have called for a district executive committee meeting. It is only Boyd Richie that is befuddled by the legality of a driver’s license.
As an aside, the GOP would probably support ANYTHING that rid CD 18 & congress of Sheila Jackson Lee…
